This legal agreement (“Terms”) is between you (“User”, “You”) and Artiza, its subsidiaries, and affiliates (“Company”, “We”, “Us”, “Our”). These Terms govern your access to and use of our applications, websites, content, products, and services (collectively, the “Services”).

1. Legal Compliance & Applicability

These Terms are published under Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 and the Information Technology Act, 2000, as applicable and amended. This is an electronic record generated by a computer system and does not require physical or digital signatures.

2. Eligibility

  • You must be at least 18 years old to use our Services.

  • If you are under 18, you must have your parent’s or guardian’s consent.

  • We may suspend or terminate accounts if we believe you are underage or in violation of applicable laws.

3. Charges & Payment

We grant you a limited, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only.

6. Account Registration & Security

  • You must provide accurate details when registering.

  • Keep your username and password confidential.

  • You are responsible for all activities under your account.

  • Notify us immediately of any unauthorized use.

7. Prohibited Activities

You must not:

  • Share login credentials.

  • Use automated systems to extract data.

  • Access or use the Platform in violation of laws.

8. Data Security & Hacking

We take reasonable measures to protect your data, but cannot guarantee complete security against cyber-attacks. You agree to indemnify us for losses arising from such events.

9. Shipping & Delivery

  • Orders are dispatched within 48 hours.

  • Address changes are accepted within 12 hours of order placement via info@artiza.com.

  • International customers are responsible for any applicable duties and taxes.

10. Disclaimer of Warranties

Our Services are provided “as is” and “as available”. We make no warranties regarding uninterrupted or error-free operation.

13. Communication

14. Non-Assignment

18. Waiver & Severability

Our failure to enforce a right does not constitute a waiver. If any provision is found invalid, the remaining terms remain in effect.

19. Termination

We may suspend or terminate your account if you breach these Terms.

21. Statute of Limitations

Any claim must be filed within one (1) year of the cause of action arising.

22. Dispute Resolution

  • Parties will first attempt to resolve disputes amicably within 15 days.

  • Unresolved disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996.

  • Arbitration will be conducted by a sole arbitrator appointed by the Company, and the decision will be final.

23. Governing Law & Jurisdiction

These Terms of Use, this Agreement, and any dispute, claim, or controversy arising out of or relating to them shall be governed by and construed in accordance with the laws of India. You agree that the courts located in Mumbai, Maharashtra, India shall have exclusive jurisdiction over any disputes arising under or in connection with these Terms, and you irrevocably submit to the personal jurisdiction of such courts.

24. Entire Agreement

These Terms constitute the entire agreement between you and Artiza and supersede all prior understandings regarding the subject matter.
